Court / Third breach of bail leads to another fine for man
A MAN who breached his bail conditions for a third time in two months has been fined again – and warned he will face jail if he does it again.
Calum Jamieson, from Ladies Drive, Lerwick, was ordered by Edinburgh Sheriff Court in late September to remain at his home address between 7pm and 7am each day.
But the 41-year-old admitted not being at his bail address on 3 November when required to by police.
Lerwick Sheriff Court heard on Friday that Jamieson – who appeared from custody – had been in the pub on the night in question, and had called for a taxi to take him home at 6.45pm.
However he claimed the taxi had left without him, meaning he was not at home at 7pm.
Procurator fiscal Duncan Mackenzie said Jamieson had called the police at 7.05pm to let them know he would not be at home.
Mackenzie said this was the third time Jamieson had breached the same bail order since the end of September.
And he said this was also not the first time Jamieson had contacted the police to say he would not be at home when required.
The fiscal said Jamieson seemed to think he could breach the conditions if he contacted the police, and it would “absolve himself of any responsibilities”.
Defence agent Ruairidh Mulheron said his client “should know better” having breached bail twice before.
He admitted Jamieson had left “simply not enough time” to get home from the pub.
And, having been held in custody from Thursday night until his court appearance on Friday, Mulheron said Jamieson had “learned his lesson”.
Mulheron urged Sheriff Ian Cruickshank to fine Jamieson for the latest breach.
The sheriff said Jamieson had been fined at his last appearance, and contemplated a different punishment.
He said this was the “third occasion in a relatively short period of time” that Jamieson had been in the dock for breaching his bail.

“At one level, this is not necessarily a serious breach,” he said.
However, he added this was “just another example” of it being “just too easy” for someone to breach bail conditions.
“The condition must be observed,” he said.
He fined Jamieson £420, to be paid on top of his previous fine, and gave him a warning that “if you don’t comply with that condition, and there’s a fourth occasion, I would not be able to deal with it financially”.
