A LERWICK man has been banned from the road for three years and slapped with a £450 fine after admitting failing to give specimens of breath to the police.
Bruce Kincaid, of Ladies Drive, appeared at Lerwick Sheriff Court on Wednesday to plead guilty to failing to provide two specimens of breath without reasonable excuse earlier this year.
The incident occurred when the 44 year old was driving a van on the town’s Holmsgarth Road on 31 May.
Procurator fiscal Duncan Mackenzie said Kincaid had “no difficulty” providing a roadside breath sample, but he started playing up after being taken to the police station in Lerwick by failing to follow orders.
Defence agent Tommy Allan said his client had been drinking during the day before sleeping, not realising that he would be over the limit.
He added that Kincaid’s depression and social anxiety contributed to the seasonal worker “panicking” in the police station.
Sheriff Philip Mann concluded that the man’s actions were worthy of a lengthy driving ban and fine.
